Mandatory Disclosure Statement - Colorado Mental Health Licensee’s
Regulation of Providers
The practice of licensed or registered persons in the field of psychotherapy is regulated by the Mental Health Licensing Section of the Division of Professions and Occupations. The Division can be reached at 1560 Broadway, Suite 1350, Denver, CO, 80202, P# (303) 894-7800 and covers the Board of Social Work Examiners or Board of Licensed Professional Counselor Examiners.
Having licensed social workers and licensed professional counselors (collectively referred to as Provider) in the state of Colorado, Complete Health Wellness Group LLC (CHWG) is required to provide you with the following information:
- Unlicensed Psychotherapist is a psychotherapist listed in the State’s database and is authorized by law to practice psychotherapy in Colorado, but is not licensed by the state and is not required to satisfy any standardized educational or testing requirements to obtain a registration from the state.
- Certified Addiction Technician (CAT/ACA)1 must be a high school graduate or equivalent, complete required training hours, 1,000 hours of supervised experience and pass the NAADAC NCAC Level I exam.
- Certified Addiction Specialist (CAS/ACC)1 must have a bachelor’s degree in clinical behavioral health, complete required training hours, 3,000 hours of supervised experience (may include hours completed for the CAT/ACA), and pass the NAADAC NCAC Level II exam.
- Licensed Addiction Counselor (LAC/ACD)1 must have a clinical master’s degree, meet the CAS/ACC requirements OR complete 2,000 additional hours of supervised experience, and pass the NAADAC MAC exam.
- Licensed Social Worker must hold a master’s degree from a graduate school of social work and pass an examination in social work.
- Licensed Clinical Social Worker (LCSW/CSW)1 must hold a master’s or doctorate degree from a graduate school of social work, practice as a social worker for at least two years, and pass an examination in social work.
- Psychologist Candidate, a Marriage and Family Therapist Candidate, and a Licensed Professional Counselor Candidate must hold the necessary licensing degree and be in the process of completing the required supervision for licensure.
- Licensed Marriage and Family Therapist must hold a master’s or doctoral degree in marriage and family counseling, have at least two years post-master’s or one year post-doctoral practice, and pass an exam in marriage and family therapy.
- Licensed Professional Counselor must hold a master’s or doctoral degree in professional counseling, have at least two years post-master’s or one year postdoctoral practice, and pass an exam in professional counseling.
- Licensed Psychologists must hold a doctorate degree in psychology, have one year of post-doctoral supervision, and pass an examination in psychology.
- If your clinician is an unlicensed psychotherapist they are not required to satisfy any standardized educational or testing requirements to obtain registration from the state.
Your Rights
As a client, you are entitled to receive comprehensive information concerning the therapeutic methods and techniques that will be employed during your treatment, as well as the anticipated duration of the therapy (if known) and the fee structure involved. Should you desire to obtain any of this information, we encourage you to make a request. You maintain the right to seek a second opinion from an external Provider outside of the CHWG premises; however, please be advised that you will bear full responsibility for any associated costs and the arrangements needed to secure such a consultation. Additionally, you may request a second opinion from an internal Provider within CHWG, though it is important to understand that we are not under any obligation to honor such requests. You hold the absolute right to discontinue therapy at your discretion and convenience. In the event that any issues arise within the working relationship with your Provider, we urge you to promptly contact our office to address such concerns. The relationship that exists between you and your Provider is to be strictly professional in nature. Any form of sexual intimacy is strictly inappropriate in this professional context, and if such conduct is observed, it should be reported immediately to the Division of Professions and Occupations. Confidentiality
Under Colorado law, it is important to understand that information exchanged between a client and the Provider during therapy sessions is protected by legal confidentiality. This confidentiality is safeguarded by both Colorado Revised Statutes and Federal laws such as the Health Insurance Portability and Accountability Act (HIPAA). It is crucial to note, however, that there are specific exceptions to this rule.
According to C.R.S. § 12-43-218 of the Colorado Revised Statutes and other applicable state and federal laws, exceptions to Provider-Client confidentiality include several scenarios: a) If a client is found to be imminently dangerous to themselves or others, or gravely disabled due to a mental disorder, the Provider, is legally obligated to initiate a mental health evaluation; b) Any suspected instance of child abuse or neglect that comes to the Provider’s attention must be reported to law enforcement authorities; c) Should a client make a threat of imminent physical harm, the Provider is mandated to report this threat to law enforcement as well as the individual(s) being threatened; d) In the event that the Provider either observe or are informed that a child, a disabled person, or an at-risk elder is experiencing or is at significant risk of abuse, neglect, or exploitation, the Provider is required to report this information; e) Any suspected threat to national security must be reported to federal officials without exception; f) The Provider may be compelled by a court order to disclose information pertaining to the client's treatment.
Additionally, if any disclosure by the client involves abuse or neglect under the aforementioned conditions, the Provider, by law, is mandated to report this to the appropriate state agency. Whenever possible and feasible, the Provider will aim to inform the client of such a disclosure. Under C.R.S. § 14-10-123.8, parents possess the legal right to access mental health treatment information regarding their minor children, unless a court order restricts this access. Should you request treatment information from the Provider, they may comply by providing a treatment summary that aligns with the requirements of Colorado law and HIPAA standards. It is essential that all parties involved recognize and understand these legal stipulations in order to uphold the integrity and confidentiality of the therapeutic process within the bounds of the law.
